Terms of Use for the Viola Farma Online Shop
1. General Provisions
These terms govern the use of the Viola Farma online shop available at shop.violafarma.lv (the “Website”).
Seller: SIA “VIOLA FARMA”, registration number 40003367731, registered office and shop address: Viskaļu iela 26, Rīga, LV-1026, Latvia (the “Seller”).
For questions about the Website, products or placing orders, the Seller can be contacted by telephone at +371 67373435, by email at [email protected] or through the contact form on the Website.
By using the Website and placing orders, the buyer agrees to review the product information and purchase terms. The relationship between the Seller and the buyer is governed by these terms, the purchase terms, delivery rules, return conditions and other applicable Website documents.
If any provision of these terms conflicts with mandatory law, the applicable laws of the Republic of Latvia and the European Union shall prevail.
2. Products and Product Information
The online shop offers medical devices, food supplements, cosmetics, personal hygiene and care products, as well as other goods listed in the relevant Website categories.
The buyer can review the description, characteristics, ingredients, instructions for use, warnings and other available information on the relevant product page.
The Seller endeavours to keep product information accurate and up to date. However, manufacturers or suppliers may update product information. If changes affect material product characteristics, the Seller takes steps to update the information accordingly.
Before using a product, buyers are advised to carefully read its labelling, ingredients, instructions and manufacturer warnings.
Information about food supplements and cosmetics is provided to describe the products and does not replace medical advice. Food supplements are not intended to diagnose, treat or prevent disease unless expressly provided otherwise by applicable law for the relevant product category.
3. Product Photographs and Images
Photographs and images on the Website are intended to help buyers become familiar with the product and its appearance.
A product image may not fully reflect the product’s actual appearance. Differences may occur in shades, colours, proportions, label design, packaging and other visual elements. These may result from the buyer’s screen settings, photographic conditions or design or packaging changes made by the manufacturer.
The manufacturer may update the packaging design without changing the product’s material characteristics. In such cases, the photograph may show a previous version of the packaging.
Buyers are advised to consider not only the image but also the product description, characteristics, ingredients and other information on the product page.
This clause does not release the Seller from the obligation to supply goods that conform to the contract. If the actual product materially differs from the stated characteristics, description or ingredients, or does not match the order, the buyer retains all rights provided by law.
4. Prices and Product Costs
All prices on the Website are shown in euros (EUR) and include value added tax (VAT), where applicable.
Delivery costs are not included in the product price unless expressly stated otherwise. Available delivery methods and their costs are shown during checkout before the order is confirmed.
The total order amount, including the selected delivery costs and any other applicable charges, is disclosed to the buyer before the contract is concluded.
Information about discounts, special offers and promotions is published in the relevant sections of the Website. The terms and validity periods are stated in the description of each promotion.
The Seller endeavours to ensure the accuracy of prices and product information. If an obvious technical error is found, the Seller contacts the buyer to resolve the matter in accordance with the law. A contract already concluded may not be arbitrarily changed to the buyer’s detriment.
5. Product Availability
Product range and availability may change.
If, after an order is placed, the selected product is found to be unavailable or impossible to supply, the Seller informs the buyer and agrees on the next steps in accordance with the circumstances and applicable law.
If the buyer has already paid for a product that cannot be supplied, the amount paid will be refunded as required by law.
Listing a product on the Website does not in itself guarantee its continued availability.
6. Placing Orders
Orders are placed using the online shop’s functions. The buyer selects products, enters the required details, chooses an available payment and delivery method, and checks the information before confirming the order.
The buyer is responsible for ensuring that the information provided, including name, delivery address, email address and telephone number, is accurate and correct.
Before finally confirming the order, the buyer must have the opportunity to check the order contents, quantities, prices, delivery costs and total amount payable.
After an order is placed, the buyer receives an acknowledgement by email or another available method.
Acknowledgement of an order and conclusion of a contract are separate actions where the Website’s ordering process so provides. The time when the contract is concluded is determined by the information provided to the buyer during checkout and the Seller’s relevant confirmations.
Detailed terms for placing, paying for and fulfilling orders are set out in the “Purchase Terms” section.
7. Payment and Delivery
Available payment and delivery methods, their costs and applicable terms are displayed on the Website during checkout.
The Seller delivers within the agreed period or, if no other period has been agreed, within the period prescribed by applicable law.
Buyers are advised to check their contact details and monitor carrier notifications if the selected delivery method includes shipment tracking or collection from a parcel locker or pick-up point.
If an order is not delivered within the expected period, the buyer should contact the Seller as soon as possible and provide the order number and, if available, the tracking number.
Buyers are strongly advised to report non-delivery no later than one month after the expected delivery period ends. Prompt notification makes it possible to check the shipment status, request information from the carrier and, if necessary, initiate an investigation while shipment information is still available.
Carriers may retain tracking data and delivery-attempt records for a limited time. A late enquiry may therefore make it significantly harder to establish what happened to a shipment.
The one-month period is a recommendation for prompt notification and does not, in itself, terminate the consumer’s legal rights.
Detailed delivery terms and procedures for delays, non-delivery and returned shipments are set out in the “Delivery” section.
8. Communicating with the Seller
Buyers may contact the Seller for information about products, product characteristics, placing orders, payment, delivery and other matters related to the online shop.
The Seller can be contacted:
- by telephone: +371 67373435;
- by email: [email protected];
- through the contact form on the Website, if available.
For questions about a specific order, buyers are advised to provide the order number. This helps locate the relevant information and handle the enquiry more quickly.
Buyers may also submit a complaint to the Seller regarding a product, delivery, payment or order fulfilment. Such complaints are handled in accordance with applicable law.
The procedure for returning goods, handling claims concerning non-conformity and other consumer protection terms are set out in the “Warranty and Returns” section.
9. Liability and Consumer Rights
The Seller takes reasonable measures to ensure that the Website operates correctly and that published information is up to date.
Temporary interruptions to the Website may occur due to maintenance, updates, connection failures or other technical circumstances.
The Seller is not responsible for disruptions to third-party websites, payment systems or carrier services that are beyond its control. However, such circumstances do not in themselves release the Seller from obligations to the buyer under the concluded contract and applicable law.
The buyer retains all rights granted under consumer protection law, including the right to withdraw from a distance contract where permitted by law and to make claims if goods do not conform to the contract.
Nothing in these terms shall be interpreted as excluding or restricting mandatory consumer rights.
10. Intellectual Property
Texts, photographs, graphics, logos, design and other Website elements may be protected by copyright and other intellectual property laws.
Copying, distributing or commercially using Website materials without appropriate permission is prohibited, except as permitted by law.
11. Links to Third-Party Resources
The Website may contain links to third-party online resources or services, such as manufacturers’ and service providers’ websites.
The Seller does not control such resources and is not responsible for their content, availability or privacy policies. Visitors are advised to review the terms of any third-party resource they use.
12. Personal Data and Cookies
Buyers’ personal data is processed in accordance with the online shop’s Privacy Policy and applicable personal data protection laws.
The use of cookies and similar technologies is governed by the cookie information published on the Website and the user’s relevant settings.
13. Changes to the Terms
The Seller may update these terms if legislation, the operation of the online shop or other circumstances change.
The current version is published on the Website. Changes do not apply retroactively to contractual obligations that have already arisen, unless permitted by law.
14. Applicable Law and Dispute Resolution
The use of the Website and the relationship between the Seller and buyers are governed by the laws of the Republic of Latvia and mandatory provisions of European Union law.
If a dispute arises, the parties may attempt to resolve it by contacting the Seller.
If the dispute cannot be resolved directly, the consumer may contact the competent consumer protection authority in Latvia or use other remedies provided by law.
